Although foreclosure proceedings can start after just one payment is missed, this would be very rare if it were to happen. Both power of sale and judicial sale require that all parties be notified of any proceedings. If the homeowner, for example, took out a second mortgage on the property, that lender must also be advised of the foreclosure so that loan amount can be paid from the proceeds from the auction. If the holder of the second mortgage is not paid at this time, the amount of the mortgage can be applied to the new owner of the property. In many cases, the lender ends up buying the property at auction in hopes of being able to offer it for sale to the public at a more attractive price.
