If you purchase a motor vehicle in the State of Mississippi, operate it on Mississippi roads and use it to transport people or property then it is covered under the Mississippi Lemon Law. It is not only new vehicles that are covered by the statute, vehicles which were used for demonstration purposes and lease-purchase vehicles are also covered as long as they are still covered by the manufacturer’s warranty.
The Lemon Law does not cover two wheel vehicles, vehicles used off-road or racing cars, only the chassis and drive train of a motor home is covered, not the area used for living purposes.
The Mississippi Lemon Law presumes that you can either opt for a refund or a replacement vehicle in the event the vehicle you purchased has defects that make it unsafe for the driver and passengers, impairs the use of the vehicle or impairs its value. As the owner you must have allowed the manufacturer a reasonable number of tries to repair the defect.
If the defect cannot be repaired in three attempts or if the car is unavailable for use by the owner for 15 days or more then the owner can give written notice to the manufacture, the manufacturer in turn has a further 10 days to tell the owner where to take it for a final repair attempt and a further 10 days to attempt the repair.
If the problem is the result of an accident or the vehicle has been abused or the recommended maintenance schedule has not been followed the law does not apply and the problem is yours.
Repairing the vehicle:
During the first year of ownership any faults that develop must be reported to the manufacturer or the dealer from which you bought the vehicle. Do not lose any documents such as receipts or shop work orders. Demand that the work order and the receipt are detailed giving the exact repairs that were made and a list of any parts used and the mileage on the odometer.
Your entitlement:
Once it has been determined that your vehicle is truly a lemon under the Mississippi Lemon Law you can have a replacement or a refund. If you elect a refund of the purchase price the manufacturer can discount this by 20 cents a mile driven as a usage charge. The decision to take a refund or a replacement is yours, not the manufacturers.
