The Lemon Law In Missouri

The thought of buying a new car and then finding out that is has some really serious problems is enough to make the hair on the back of your neck to stand up. Fortunately the Missouri Lemon Law which in the state is called the “Missouri New Vehicle Warranty Law” is in place to protect you. This law is a tremendous help for those who bought a car fraught with problems as it forces the vehicle manufacturer to honor the express warranty.

Basically the lemon law in Missouri requires that the manufacturer either refund the purchase price of the vehicle or to replace it. These options are available to the purchaser after he or she has given the manufacturer a reasonable number of attempts to eliminate the problem.

The Missouri Lemon Law and North Dakota Lemon Law covers cars that have been purchased or leased and that are still under the manufacturer’s new car warranty. The law in Missouri does not provide any protection for vehicles used for commercial purposes, vehicles that are designed for use off-road, mopeds and motorcycles as well as the living area of RVs and motor homes.

If your car has been out of service, unavailable for use for at least 30 business days or you have had it in the shop at least four times for the same fault you qualify for protection under the lemon law of the state. If your complaint is deemed valid then the manufacturer is obliged to provide a new replacement or to refund the price you paid for the car.

As the owner or lessee of the vehicle you must give the manufacturer formal notice that you plan on filing a complaint, this move is what initiates the final opportunity to fix the problem otherwise you will elect refund or replacement.

In the event the manufacturer denies your request you have options, you can start an informal dispute process but if this process is not available to you then you are free to sue in court. Even if there is an informal dispute process, if you are not happy with the outcome you can still sue.

The Missouri Lemon Law does not provide any protection to the buyer of a used car. If you do purchase a used car in Missouri then as the buyer you assume all the risks that it may fail or suffer from serious defects.
